Consolidated (MDL)Hernia Mesh Lawsuit 2026: Bard Settlement, Covidien $88 Million Verdict, and Who Qualifies
Bard settled most hernia mesh claims in 2024, and a jury awarded $88M in the first Covidien bellwether in August 2026. See who still qualifies to file.

Hernia mesh lawsuits are still active in 2026: Bard's parent company settled the vast majority of its hernia mesh claims in 2024, while claims against Covidien are heading to more trials after a jury awarded $88 million in the first federal bellwether on August 4, 2026. People who had hernia repair with Bard/Davol, Covidien, Atrium C-Qur, or Ethicon Physiomesh mesh and then suffered serious complications or needed revision surgery may qualify. Who can still file depends heavily on the brand and your state's deadline.
This page covers each manufacturer's litigation, what the verdicts and settlements show, who qualifies, and what to do.
Key takeaways.
- On August 4, 2026, a federal jury in Boston awarded $88 million in the first Covidien hernia mesh bellwether trial, finding Covidien failed to adequately warn about its Symbotex mesh.
- Becton, Dickinson and Company, which owns Bard and Davol, entered a settlement in its fiscal fourth quarter of 2024 to resolve the vast majority of its existing hernia litigation.
- The JPML listed 23,316 cases pending in the Bard MDL and 2,453 in the Covidien MDL on September 1, 2026.
- The Atrium C-Qur MDL was down to 127 pending cases and Ethicon Physiomesh to zero.
- New cases turn on the mesh brand, the injury, revision surgery, and your state's deadline.
You may qualify if.
- You had a hernia repaired with surgical mesh made by Bard/Davol, Covidien, Atrium (C-Qur), or Ethicon (Physiomesh).
- You later had a complication such as chronic pain, infection, mesh migration, shrinkage, adhesions, bowel obstruction, or erosion.
- You needed revision surgery to remove or repair the mesh, or a doctor has recommended it.
- You can identify the mesh product from your operative report or implant record.
- People with no complications, or whose claims were already resolved in the Bard settlement, generally cannot bring a new claim for the same injury.
What to gather.
- 1The operative report and implant sticker or device log from your hernia surgery, naming the mesh brand and lot.
- 2Records of complications, imaging, and every follow-up or revision surgery.
- 3Pathology or explant records if mesh was removed.
- 4Medical bills and proof of time missed from work.
- 5Any settlement paperwork or letters from a prior attorney, if you were part of the Bard program.
What the hernia mesh lawsuits allege
Hernia mesh is a synthetic screen, often polypropylene, sewn or tacked over a weak spot in the abdominal wall to reinforce a hernia repair. The lawsuits say certain mesh products were defectively designed or sold without adequate warnings, leading to chronic pain, infection, adhesions to the bowel, mesh migration or shrinkage, perforation, and repeat surgery. The manufacturers deny the claims.
Bard and Davol (MDL 2846)
Claims over Bard and Davol polypropylene hernia mesh products are centralized as In re: Davol, Inc./C.R. Bard, Inc., Polypropylene Hernia Mesh Products Liability Litigation, MDL No. 2846, in the Southern District of Ohio before Judge Edmund A. Sargus Jr. A large coordinated proceeding also runs in Rhode Island state court.
Covidien (MDL 3029)
In re: Covidien Hernia Mesh Products Liability Litigation (No. II), MDL No. 3029, is in the District of Massachusetts before Judge Patti B. Saris. Covidien is part of Medtronic. The claims involve mesh products including Parietex, ProGrip, and Symbotex.
Atrium C-Qur (MDL 2753)
Claims over Atrium Medical's C-Qur mesh, which had an omega-3 fatty acid coating, are in MDL No. 2753 in the District of New Hampshire before Chief Judge Landya B. McCafferty.
Ethicon Physiomesh (MDL 2782)
Claims over Ethicon's Physiomesh Flexible Composite mesh were centralized in MDL No. 2782 in the Northern District of Georgia before Judge Richard W. Story.
These are individual injury cases in a mass tort. Allegations are not proven except where a jury has ruled in a specific case.
Across the four MDLs listed here, the JPML's September 2026 report shows more than 35,000 hernia mesh cases filed in federal court over the life of the litigation. That total (25,213 Bard, 2,459 Covidien, 3,592 Atrium, and 4,054 Physiomesh) does not include state court cases such as the Rhode Island Bard proceeding.
Where each hernia mesh MDL stands

Bard: settlement being administered
Becton, Dickinson and Company (BD) reported that in the fourth quarter of its fiscal year 2024 (July to September 2024), it entered a settlement agreement to resolve the vast majority of its existing hernia litigation, payable over several years. BD did not disclose the amount. As of June 30, 2026, BD said it was still defending about 7,090 hernia product claims, that most are in the Rhode Island and Ohio proceedings, and that no trials were scheduled. The large JPML pending count reflects cases that have not yet been formally dismissed as settlement payments are processed.
Covidien: first bellwether verdict
The first federal Covidien bellwether, brought by Larry Patterson and his wife Tammy, ended August 4, 2026 with an $88 million verdict: $77 million for Mr. Patterson and $11 million for his wife's loss of consortium claim. According to the trial team, Mr. Patterson received Symbotex mesh in a 2017 repair; its protective collagen coating dissolved in about seven days rather than the roughly 30 days doctors expected, the mesh adhered to his bowel, and he needed surgery to remove it along with several inches of intestine. The jury found Covidien failed to warn physicians of the risks. The verdict resolves only the Pattersons' claims and can still be challenged through post-trial motions and appeal.
Atrium and Ethicon: largely resolved
The Atrium MDL has shrunk from 3,592 total cases to 127 pending, and the Physiomesh MDL shows no pending cases of 4,054 filed, reflecting settlements and dismissals.
Who may qualify for a hernia mesh lawsuit
Attorneys generally look for:
- Brand identification. Your operative report or implant record should name the product. Without it, a claim is hard to pursue.
- A significant complication after the repair: chronic pain, infection, adhesions, obstruction, migration, or erosion.
- Revision surgery to remove or repair the mesh, or a documented recommendation for one. Revision is often the dividing line in how claims are valued.
- Timing within your state's filing deadline, measured from when you knew or should have known the mesh caused the problem.
You likely do not qualify if you had no complications, if your problems came from a recurrence unrelated to the mesh, or if you already released your claim in a settlement. For Bard mesh, most represented claimants were folded into the 2024 settlement, so new Bard claims are harder to place. Covidien claims remain the most active path.
If you had more than one hernia repair, each with different mesh, list them all; an attorney will need to know which product was in place when problems began.
What hernia mesh compensation looks like
Real figures from this litigation:
- $88 million: the August 2026 Covidien bellwether verdict for one couple, subject to post-trial motions and appeal.
- Bard 2024 settlement: resolves the vast majority of Bard's existing claims; the total and per-person amounts were not disclosed.
A single verdict is not a benchmark for typical settlements. Bellwether plaintiffs are chosen to test the strongest and weakest cases, and large verdicts are often reduced after trial. Settlement programs usually tier payments by whether you had revision surgery, how many, and lasting harm such as bowel injury. Attorneys typically take a contingency fee, and health insurers or Medicare may have liens. See how settlement money is divided.
The legal theories behind mesh claims
Hernia mesh cases are state-law product liability claims, typically design defect, failure to warn, and negligence. Unlike many drugs, most hernia meshes reached the market through the FDA's 510(k) clearance process, which rests on similarity to earlier devices rather than full premarket approval. That matters because in Riegel v. Medtronic (February 20, 2008) the U.S. Supreme Court held that many state-law claims against devices with full premarket approval are preempted, a defense that 510(k)-cleared devices generally cannot use in the same way.
In the Patterson trial, the jury's finding rested on failure to warn physicians, the theory most likely to recur in the remaining Covidien bellwethers.
Hernia mesh lawsuit deadlines
Each claim is governed by the plaintiff's state statute of limitations for personal injury, commonly two or three years from when you knew or should have known the mesh caused your injury. Some states also have statutes of repose that bar claims a fixed number of years after the product was sold or implanted, regardless of when you found the problem.
The date of a revision surgery, or a surgeon's statement that the mesh failed, is often treated as a key discovery date. If that happened more than a year or two ago, get your records reviewed now.
A statute of limitations of two or three years is common, but a statute of repose can bar a claim even if you only recently learned the mesh was the cause. Because many hernia repairs happened a decade or more ago, repose periods are a real issue in mesh cases. An attorney will need the implant date as well as the date problems started.
Keep a simple list of dates: implant, first symptoms, diagnosis, and each surgery.
What Bard settlement claimants and new filers should know
The hernia mesh litigation is at different stages for each manufacturer, so the practical advice depends on your mesh.
If you have a Bard or Davol claim
BD says the settlement it entered in fiscal 2024 covers the vast majority of its existing hernia litigation, that the amounts are included in its accrual, and that payments will be made over several years. BD reported defending about 7,090 hernia product claims as of June 30, 2026, up from about 6,905 on September 30, 2025, with no trials scheduled. If you are represented, your attorney is the source for your award tier and payment timing. If you are not represented and have a Bard mesh injury, ask an attorney whether your claim falls inside or outside the settlement program.
If you have a Covidien mesh
Covidien is where the active trial calendar is. The MDL court is testing bellwether cases, the first produced an $88 million verdict for the plaintiffs, and the court's handling of post-trial motions and later bellwethers will shape any settlement talks. The trial evidence focused on Symbotex, but the MDL also involves Parietex and ProGrip products.
If you have Atrium C-Qur or Ethicon Physiomesh
These MDLs are winding down. New cases may still be possible in some courts, but they are harder to place, and deadlines are a bigger concern because the litigation has been public for years.
Signs of mesh complications people commonly report
People in these cases often describe persistent pain at the repair site, a bulge or recurrence, fever or drainage suggesting infection, nausea or bowel changes, or pain with movement. These can have many causes, so they need a doctor's evaluation. Medically, only your surgeon and imaging can tell you whether the mesh is involved; legally, that documentation is what makes a claim possible.
What to do now after a hernia mesh complication
- Get your operative report from the hospital; it should name the mesh product.
- Keep every record of complications, imaging, and revision surgeries.
- Ask about the explanted mesh if you have revision surgery; hospitals may be able to preserve it.
- Do not sign a release from a manufacturer or insurer without legal advice.
- If you were in the Bard program, contact your own attorney about payment timing rather than third parties.
In a case review, expect questions about the date and hospital of your hernia repair, the mesh brand if you know it, when problems began, and every procedure since. If you do not know the brand, that is common; the hospital's implant log usually has it, and an attorney can request it with your authorization.
Independent attorneys who handle hernia mesh cases can check your product, injury, and deadline. A free case review takes about two minutes. Related reading: what an MDL is, the Bard PowerPort lawsuit, and the spinal cord stimulator lawsuit.

Hernia mesh: common questions.
Is the hernia mesh lawsuit still going on?
Yes. As of September 2026, the Covidien hernia mesh MDL had 2,453 pending cases and more bellwether trials ahead, and Bard's MDL was processing a 2024 settlement covering most of its claims. The Atrium and Ethicon Physiomesh MDLs were largely resolved.
How much is the Bard hernia mesh settlement per person?
Becton, Dickinson did not disclose the total or per-person amounts of the settlement it entered in fiscal 2024. Individual payouts in programs like this usually depend on revision surgeries and lasting injuries.
What was the Covidien hernia mesh verdict?
On August 4, 2026, a federal jury in Massachusetts awarded $88 million to Larry Patterson and his wife in the first Covidien bellwether trial, finding inadequate warnings about Symbotex mesh. The verdict can still be challenged through post-trial motions and appeal.
Who qualifies for a hernia mesh lawsuit?
Generally, people who had hernia repair with Bard/Davol, Covidien, Atrium C-Qur, or Ethicon Physiomesh mesh and suffered serious complications, especially if they needed revision surgery. You need records identifying the mesh brand.
Is there a hernia mesh class action?
In the United States, hernia mesh cases are handled as individual claims in MDLs and state court proceedings, not class actions. BD reports that putative class actions are pending in Canada.
How do I know what hernia mesh I have?
Ask the hospital for your operative report and implant record, which usually list the manufacturer, product name, and lot number. Your surgeon's office can also help identify it.
