How much money can you get?

Class members can claim up to three benefits on one form. The first two are cash, and you can claim both.

BenefitAmountProof needed
Pro rata cash paymentEstimated $50, up to $450None
Out-of-pocket lossesUp to $5,000 per personReceipts or statements
Credit monitoring (IDX)2 years, one bureauNone

The no-proof cash payment is estimated at $50 per claimant, but the final amount depends on how many people file and can range up to a $450 cap. It is paid from what is left of the common fund after documented loss claims, credit monitoring, administration costs, and court-approved fees are paid, so a large response will push it down.

For documented losses, you need records that were not prepared by you, such as bank statements showing fraud charges, receipts for credit freezes, or invoices for identity theft help. Handwritten notes alone are not enough, though they can explain other documents. You also have to say whether anyone already reimbursed you.

Fees come out of the fund too. Class counsel said it would ask for attorneys' fees of up to one-third of the $2.5 million, plus costs, and service awards of up to $3,500 for each of the eight class representatives. The court decides how much to award. For context on typical breach payouts, see our guide on how much a data breach settlement is worth.

If you missed the deadline or want to opt out

The deadline to opt out or object was August 28, 2026, and it has passed. If you did not opt out by August 28, 2026, you are bound by the settlement and give up the right to sue ABC over this incident, whether or not you file a claim. That is why filing makes sense even if the payment is small: doing nothing gets you nothing and still releases your claims.

If you miss the September 28 claim deadline, you will not get cash or monitoring. Administrators sometimes accept late claims at their discretion, but there is no promise. Contact the administrator right away if you are late.

People who opted out keep their own right to sue. If you suffered serious, documented identity theft costing more than $5,000 and you opted out in time, a free case review with independent attorneys who handle breach cases can help you understand your options.
