What the Equinox data breach settlement resolves
According to the complaint, Equinox, Inc. is a nonprofit community organization based at 50 Central Avenue in Albany that provides human services in New York's Capital Region, including domestic violence support, mental health counseling, substance abuse treatment, and help for at-risk and homeless youth. It is not the Equinox fitness club chain, and gym membership alone does not put you in this settlement.
The class notice says that on or about April 29, 2024, Equinox became aware of suspicious activity on its network, and its investigation found that cybercriminals accessed individuals' private information. The information involved includes names, addresses, dates of birth, Social Security numbers, driver's license numbers, health insurance information, medical treatment or diagnosis information, medication information, financial information, provider names, and medical record or patient ID numbers.
Two clients, Rossana McHugh and Andrea Carter, filed suit in state court in Albany. Equinox denies the claims, and no court has found that it did anything wrong. Besides money, Equinox says it has adopted security changes, which it will describe to class counsel in a confidential declaration. For how these data breach cases generally work, see our data breach lawsuit guide.

How much can I get from the Equinox settlement?
| Benefit | Amount | Proof |
|---|---|---|
| Pro rata cash | About $100 (estimate) | None |
| Documented losses | Up to $5,000 | Reasonable documentation and attestation |
| Credit monitoring | 3 years, one bureau | Elect on claim form |
You can claim documented losses and the pro rata payment together. Documented losses can include credit monitoring you paid for on or after April 29, 2024, unreimbursed fraud or identity theft losses, bank fees, long distance charges, postage, and local mileage at the IRS business rate. You must attest that the losses came from the data incident, and you cannot be paid for costs already reimbursed. If your documentation is rejected and not fixed, your claim is treated as a pro rata cash claim.
The settlement fund is a non-reversionary $685,000, and the $100 figure is only an estimate that moves up or down with the number of valid claims. Money is paid in this order: administration costs, service awards (up to $2,500 each for two plaintiffs), attorneys' fees and expenses (class counsel may seek up to one-third, $228,333.33), then documented losses, then credit monitoring, and only then the pro rata cash. If many people file, the $100 shrinks. The monitoring includes dark web monitoring and up to $1 million in identity theft insurance. See how much a data breach settlement is worth.
