Emotional Distress

Mental suffering such as anxiety, fear, humiliation, or depression caused by someone else's conduct. It can be part of damages in many lawsuits and, in some cases, its own legal claim.

Emotional distress is the legal term for mental and emotional harm, including anxiety, fear, grief, humiliation, sleeplessness, and depression. In most lawsuits, it is part of the damages a person can recover alongside physical injuries and financial losses, often grouped with pain and suffering.

Emotional distress can also be a claim on its own. Intentional infliction of emotional distress generally requires extreme and outrageous conduct that intentionally or recklessly causes severe emotional distress, a demanding standard that ordinary rudeness or insults do not meet. Negligent infliction of emotional distress is narrower and varies a lot by state; many states require that the person was physically injured, was in the "zone of danger," or witnessed a close family member being seriously hurt.

In class actions, emotional distress is usually hard to recover on a group basis, because courts see it as individual: one person may be deeply shaken by a data breach while another shrugs it off. That is one reason data breach settlements tend to pay for documented losses and time spent rather than anxiety. Some statutes help, though. Several consumer protection laws, including the Fair Credit Reporting Act and the FDCPA, allow recovery of actual damages that courts have held can include emotional distress, and individual cases involving abuse or harassment often center on it.

If emotional harm is part of your claim, a record helps: notes on symptoms, counseling or medical visits, and how daily life changed. See our guides on the FDCPA and class action versus individual lawsuit.
