SettledChantix Nitrosamine Lawsuit: $44 Million Settlement and Case Status
Pfizer's $44M Chantix settlement closed to claims September 14, 2026, with a final hearing set for October 13. It covers Chantix bought from 2015 to 2021.

The Chantix nitrosamine lawsuit ended in a $44 million Pfizer settlement for people who paid for brand Chantix from September 29, 2015 through September 17, 2021, but the deadline to file a claim was September 14, 2026. If you filed, the next step is the final approval hearing on October 13, 2026, and payments come after that. If you missed it, you will not be paid from this fund, and the case does not cover cancer or other injuries.
Below: what the recall found, how the case got here, who is covered, what payments may look like, and what you can still do.
Key takeaways.
- Pfizer agreed to pay $44,000,000 to settle claims that Chantix contained an undisclosed nitrosamine, N-nitroso-varenicline, covering purchases from September 29, 2015 through September 17, 2021.
- The claim, opt-out, and objection deadline was September 14, 2026. The final approval hearing is set for October 13, 2026.
- Consumer payments are pro rata, capped at 20% of the available fund in total, and no consumer can get more than they paid for Chantix.
- Pfizer recalled all lots of Chantix 0.5 mg and 1 mg tablets by September 17, 2021, and denies wrongdoing.
- The case is MDL 3050 in the Southern District of New York, centralized by the JPML on December 22, 2022.
You may qualify if.
- You paid any amount, including a copay, for a retail purchase of brand name Chantix in the United States or its territories from September 29, 2015 through September 17, 2021.
- Third-party payors, such as health plans that reimbursed Chantix purchases in that period, are also in the class.
- To receive money you had to submit a claim by September 14, 2026. That deadline has passed.
- Generic varenicline and Apo-Varenicline are not brand Chantix and are not part of this Pfizer settlement.
- The case is about money paid for the drug. It does not compensate cancer or other injuries.
What to gather.
- 1Pharmacy records or insurer statements showing Chantix fills, dates, and out-of-pocket amounts.
- 2Your claim confirmation number from chantixsettlement.com, if you filed.
- 3Any recall letter from your pharmacy or doctor from 2021.

What the Chantix lawsuit was about
Chantix (varenicline) is Pfizer's prescription drug to help people quit smoking. In 2021, testing found it contained N-nitroso-varenicline (NNV), a nitrosamine impurity. Nitrosamines are the same family of chemicals behind recalls of valsartan, ranitidine, and metformin.
The FDA set an acceptable intake limit for NNV of 37 nanograms per day. Pfizer began recalling Chantix lots in mid 2021, expanded the recall to 12 lots on July 19, 2021, and then went further. On September 17, 2021, the FDA announced that Pfizer was expanding its voluntary recall to include all lots of Chantix 0.5 mg and 1 mg tablets because of unacceptable N-nitroso-varenicline levels. That date became the end of the class period.
The FDA said NNV may be associated with a potential increased cancer risk with long-term use, that there was no immediate risk to patients, and that the health benefits of quitting smoking outweigh the cancer risk from the impurity. To prevent a shortage, it temporarily allowed some varenicline with NNV below an interim limit of 185 nanograms per day.
Consumers and health plans sued, claiming Pfizer sold a drug with an undisclosed impurity that was not made in compliance with current good manufacturing practices, so they overpaid. The consolidated complaint described NNV as a genotoxic, probable human carcinogen. These were allegations. Pfizer denies that it did anything wrong or violated any law, and no court decided who was right.
Where the Chantix case stands now
The case is In re Chantix (Varenicline) Marketing, Sales Practices and Products Liability Litigation (No. II), MDL 3050, No. 1:22-md-03050-KPF, in the Southern District of New York before Judge Katherine Polk Failla. According to the plaintiffs' preliminary approval brief, the JPML centralized eight cases on December 22, 2022, and eight more joined in January 2023.
The case was partly narrowed before it settled. On May 28, 2024, Judge Failla denied part of Pfizer's motion to dismiss, letting consumer protection and some unjust enrichment claims go forward. On May 6, 2025, the court dismissed the express and implied warranty claims and most negligence-based claims. Discovery followed, with more than 250,000 documents reviewed.
The parties signed a settlement agreement on May 18, 2026, and the court granted preliminary approval. A.B. Data, Ltd. is the settlement administrator. According to the official settlement website, the deadline to file a claim, opt out, or object was September 14, 2026, and the fairness hearing is scheduled for October 13, 2026, at 3:00 p.m. Those dates replaced earlier ones in the preliminary approval order after a notice extension order in June 2026.
As of September 1, 2026, the JPML listed 17 actions pending in MDL 3050. For the settlement details in one place, see our Chantix $44 million settlement page.
Chantix recall details and what replaced it
The recall unfolded in stages over the summer of 2021, which is why many patients only learned about it at the pharmacy counter. The FDA's announcements show the sequence: Pfizer's initial recall of a limited number of lots, the July 19, 2021 expansion to 12 lots, and the September 17, 2021 expansion to every lot of both strengths.
Because Chantix was the only brand of varenicline widely sold in the United States at the time, the recall threatened a shortage. The FDA responded in two ways. In July 2021, the FDA said it would not object to certain manufacturers distributing varenicline with N-nitroso-varenicline above the 37 nanogram per day acceptable limit but below an interim limit of 185 nanograms per day. It also temporarily allowed Apotex to distribute its Health Canada approved Apo-Varenicline tablets in the United States.
The FDA explained its reasoning: its scientists found that exposure up to the interim level presented minimal additional cancer risk compared with a lifetime at the 37 nanogram level, and that the benefits of quitting smoking outweigh that risk. The agency updated this regulatory flexibility again on May 5, 2022.
For class members, the practical point is that only brand Chantix purchases from September 29, 2015 through September 17, 2021 count for this settlement. Varenicline you filled from another maker, or after the recall, is outside it. If you are unsure what you received, your pharmacy's fill history will list the product name and manufacturer for each fill.
Who is covered by the Chantix settlement
The settlement class includes all individuals and third-party payors who paid any amount of money for retail purchases of Chantix in the United States and its territories from September 29, 2015, through September 17, 2021. That six year class period is long enough that many people who tried Chantix once to quit smoking are in it.
- Covered: anyone who paid a copay, coinsurance, or the full price for brand Chantix at a retail pharmacy in the window, and health plans that reimbursed it.
- Not covered: generic varenicline from other makers, and Apo-Varenicline imported under FDA's temporary shortage measures.
- Not covered: people seeking compensation for cancer or other health problems. This is an economic case, not a personal injury case.
If you did nothing and did not opt out, you are still a class member. You will be bound by the settlement and give up the right to sue Pfizer over these claims, but you will not receive money unless you filed a claim. See can you be bound by a class action settlement.
Proof mattered for filing. The claim form asked claimants to include supporting documents if possible, and because each consumer payment is capped at the amount that person paid, records of out-of-pocket costs directly affect how much can be paid. Pharmacy printouts, insurer explanation of benefits statements, and receipts all help. If the administrator contacts you to verify a claim, answer promptly; unanswered requests are a common reason claims are reduced or denied. Health plans and other third-party payors were asked for claims data showing their Chantix payments. Class counsel appointed by the court are Honik LLC, Levin Sedran & Berman LLP, and Scott+Scott Attorneys at Law LLP, and class members do not pay them directly; their fees come out of the $44 million fund if the court approves.
How much the Chantix settlement pays
The $44 million fund pays for notice and administration, attorneys' fees, litigation costs, and service awards to the class representatives before anything goes to class members. Class counsel said they would ask for no more than one-third of the fund in fees, plus costs.
The split is unusual and matters for individuals. Total payments to consumers are capped at 20% of the available settlement fund, and each consumer's payment cannot exceed what that person actually paid for Chantix. The remainder goes to third-party payors, pro rata based on their documented payments. Health plans usually paid most of the cost of the drug, which explains the allocation.
In practice, a consumer who paid modest copays for a single course will probably receive a modest amount, possibly well under what they paid if many people file. People who paid full cash price over several courses have larger claims but are still capped at their own spending. No official per-person estimate has been published. Payments are expected only after final approval and any appeals. For why payouts often disappoint, see why your payout may be smaller than expected.
The law behind the Chantix claims
The core legal theory was that a drug containing an undisclosed impurity, made outside current good manufacturing practices, is not what buyers paid for. The surviving claims were under state consumer protection statutes, unjust enrichment, and negligent misrepresentation under two states' laws.
The court's rulings show how these cases get narrowed. Warranty claims were dismissed in May 2025, and the plaintiffs were seeking reconsideration after a 2026 Supreme Court decision when the case settled. Those risks, plus the challenge of proving class-wide damages, are the reasons class counsel gave for settling.
Because the harm was economic, nobody had to prove they got sick. That is also why the recovery is limited to amounts paid. The FDA's position that the benefits of quitting smoking outweigh the NNV cancer risk would make individual injury claims difficult, and no Chantix nitrosamine personal injury MDL exists. The broader class action structure is explained in how a class action lawsuit works.

Claims had to be submitted online or postmarked by September 14, 2026. Late claims are generally rejected unless the court or parties allow them. If you missed the deadline, you can call the administrator at 1-877-354-3912 to ask, but do not count on it. The fairness hearing date can change without further notice, so check the official site before relying on it. If the court grants final approval and no one appeals, payments typically follow within several months.
What to do now
- If you filed, keep your confirmation number, respond to any request from the administrator for documents, and keep your mailing and email address current.
- If you did not file, you are bound by the settlement unless you opted out, and there is no second chance built into this deal. Watch for similar nitrosamine cases, such as the metformin NDMA lawsuit.
- Do not pay anyone to file or check a claim. Only chantixsettlement.com and the administrator handle claims, and it is free. See how to spot settlement scams.
- If you have a serious health problem you believe is related to a drug you took, that is a separate question from this class settlement. Talk with your doctor about treatment and with an attorney about any individual claim.

Chantix nitrosamine: common questions.
Is there a Chantix class action lawsuit?
Yes. Chantix buyers sued Pfizer over the nitrosamine impurity N-nitroso-varenicline in MDL 3050 in the Southern District of New York. Pfizer agreed to a $44 million class settlement in 2026 while denying wrongdoing.
How much will I get from the Chantix settlement?
There is no fixed amount. Consumer payments are pro rata, together capped at 20% of the available fund, and no one can receive more than they paid for Chantix. Most consumer payments are expected to be modest.
What is the deadline for the Chantix settlement?
Claims had to be submitted online or postmarked by September 14, 2026, which was also the opt-out and objection deadline. That deadline has passed.
Who qualifies for the Chantix settlement?
Individuals and third-party payors who paid any amount for retail purchases of brand Chantix in the United States and its territories from September 29, 2015 through September 17, 2021.
When will Chantix settlement payments be sent?
Only after the court grants final approval and any appeals end. The final approval hearing is scheduled for October 13, 2026, so payments would come after that date.
Can I sue Pfizer for cancer from Chantix?
The class settlement covers only money paid for the drug, not injuries. There is no Chantix nitrosamine personal injury MDL, and the FDA said the benefits of quitting smoking outweigh the impurity's cancer risk, which makes injury claims difficult.
Why was Chantix recalled?
Pfizer recalled Chantix in 2021 because tablets contained N-nitroso-varenicline above the FDA's acceptable intake limit of 37 nanograms per day. By September 17, 2021, the recall covered all lots of the 0.5 mg and 1 mg tablets.
