What the Chantix settlement resolves
Chantix (varenicline) is Pfizer's prescription stop-smoking drug. The lawsuits claimed Pfizer failed to follow current good manufacturing practices, so Chantix became contaminated with a nitrosamine, which the plaintiffs' fee brief identifies as N-nitroso varenicline, a probable human carcinogen. Pfizer recalled the drug. Buyers argued they overpaid for a product that was not what Pfizer represented.
Cases filed around the country in 2021 were centralized as multidistrict litigation in the Southern District of New York before U.S. District Judge Katherine Polk Failla. The claims originally included breach of warranty, the Magnuson-Moss Warranty Act, fraud, negligence, and unjust enrichment. According to the class notice, earlier court rulings narrowed the case to state consumer protection claims and certain unjust enrichment and negligent misrepresentation claims based on Pfizer's statements about its manufacturing practices.
The settlement was fully signed on May 18, 2026, and the court granted preliminary approval on June 1, 2026, after more than five years of litigation. Pfizer denies wrongdoing. This settlement pays for money spent on the drug. It does not compensate for any illness, and people who believe they were injured should read about the Chantix lawsuit separately.
Who is in the Chantix settlement class?
The class is all individuals and third-party payors who paid any amount of money for retail purchases of Chantix in the United States and its territories from September 29, 2015 through September 17, 2021.
- Any amount counts, including a copay or coinsurance. You did not need to pay full price.
- Third-party payors are health plans, insurers, and similar entities that paid for members' Chantix. They have their own notice and claim process.
- Excluded: Pfizer and its officers, directors, employees, subsidiaries, and affiliates; government agencies, including state attorney general offices; and anyone who previously opted out.
If your insurance or a government program paid the whole cost and you paid nothing out of pocket, you likely had nothing to claim as a consumer. The administrator posted a list of Chantix NDC codes on the Notice/FAQs page so buyers could match their pharmacy records.
How much will Chantix claimants get?
The money is split in two stages. First, attorneys' fees, expenses, notice and administration costs, and service awards come out of the $44 million. Then:
| Group | Share of net fund | How it is divided |
|---|---|---|
| Consumers | Up to 20% | Pro rata by dollars paid |
| Third-party payors | The remainder | Pro rata by documented payments |
Each consumer's payment cannot exceed the total amount that person paid for Chantix. Class counsel's fee petition asks for no more than one-third of the fund plus expenses, and the notice says counsel would seek $5,000 service awards for each consumer plaintiff and $15,000 for each third-party payor plaintiff.
A rough ceiling helps set expectations. If the court awards one-third in fees, about $29 million would remain before costs, and 20% of that is roughly $5.9 million for all consumers combined. Your share depends on how much you paid and how many other consumers filed. No official per-person estimate has been published, so treat any figure you see online with caution. How claims were filed and what proof was needed
Claims were filed online at ChantixSettlement.com or by mail to Chantix Settlement, c/o A.B. Data, Ltd., P.O. Box 173137, Milwaukee, WI 53217. The online deadline was 11:59 p.m. Eastern on September 14, 2026, and the website now says the filing window has closed.
Proof matters in this settlement. The settlement agreement says consumers should submit documentation with the claim form to support each claim, and the administrator may require documentation for any claim. Because payments are based on dollars paid "as documented," pharmacy receipts, pharmacy printouts of prescription history, or insurance explanation of benefits statements are what support a payment.

Key dates for the Chantix settlement
| Event | Date |
|---|---|
| Preliminary approval | June 1, 2026 |
| Claim, opt-out, and objection deadline | September 14, 2026 (passed) |
| Final approval hearing | October 13, 2026, 3:00 p.m. |
| Payments | After final approval and any appeals |
The fairness hearing is set for October 13, 2026 at 3:00 p.m. in Courtroom 618 of the Thurgood Marshall U.S. Courthouse, 40 Foley Square, New York. The date was pushed back after a June 2026 order extended the notice schedule by two weeks, and it can change again without notice. Even after approval, the notice warns that appeals and claim processing take time.
What if I missed the Chantix deadline?
If you are a class member who did not file or opt out by September 14, 2026, you will not receive a payment, and once the settlement becomes final you give up the right to sue Pfizer over the economic loss claims it releases. The notice says exactly this for people who do nothing.
The release covers the claims in this case about paying for Chantix. If you believe Chantix caused you a health problem, that is a different kind of claim, and the rules on what was released are in the settlement agreement on the official website. A free case review can connect you with independent attorneys who can read the release and tell you whether any personal injury claim may remain.
