Investigation openWalmart Mainstays Dresser Tip-Over Recall: Refunds, Injuries, and Lawsuits
No class action yet: about 165,250 Mainstays 9-drawer dressers were recalled for tip-over risk. Owners get a Walmart refund; injured kids may have a claim.

Walmart is recalling about 165,250 Mainstays 9-Drawer Fabric Dressers because they can tip over onto children, and every owner can get a full refund, but as of September 2026 there is no class action lawsuit over the recall. If you own one, stop using it unless it is anchored, keep it away from kids, and contact Walmart. If a Mainstays dresser tipped over and hurt someone, that is a separate injury claim, and it can be worth far more than the refund.
Below: which dressers are recalled, how to get your money back, the older Mainstays chest recall, what past tip-over cases paid, and the deadlines that matter.
Key takeaways.
- Walmart recalled about 165,000 Mainstays 9-Drawer Fabric Dressers on May 28, 2026, and reannounced the recall on August 27, 2026 after recalled units were sold through liquidators.
- The remedy is a full refund: return the drawers to any Walmart store and dispose of the metal frame.
- CPSC says the dressers violate the mandatory STURDY Act stability standard; no injuries had been reported.
- We found no class action filed over this recall. Owners who were not hurt will usually get more from the refund than from a lawsuit.
- If a dresser tipped over and injured someone, keep the dresser and records; an individual injury claim is where real compensation happens.
You may qualify if.
- Anyone who owns a Mainstays 9-Drawer Fabric Dresser bought at Walmart or Walmart.com from September 2023 through March 2026 can get a full refund through the recall.
- People who bought one of these dressers from the liquidators OMG California Community, Threads of Fenton, Golden Cone Electronic, or ReturnPro after the May 2026 recall are also covered by the refund.
- A child or adult who was hurt when a Mainstays dresser tipped over may have an individual injury claim against the seller or maker, whether or not the model was recalled.
- Families who lost a child in a dresser tip-over may have a wrongful death claim, subject to their state's deadline.
- Owners with no injury are usually limited to the recall refund; a lawsuit is unlikely to pay more than the roughly $80 purchase price.
What to gather.
- 1The dresser itself, left as it was after any tip-over, plus the drawers, hardware, and any anchor kit.
- 2The label under the top panel showing the Tracking/Lot number and the MM/YYYY manufacture date.
- 3Your Walmart receipt, Walmart.com order history, or liquidator invoice showing the product name "Mainstays 9-Drawer Fabric Dresser".
- 4Photos of the room, the dresser's position, and whether it was anchored to the wall.
- 5Medical records, ER bills, and photos of injuries, plus names of anyone who saw the tip-over.
- 6Any recall notice, email, or refund confirmation from Walmart.
What the Walmart Mainstays dresser recall covers
The U.S. Consumer Product Safety Commission (CPSC) announced the recall on May 28, 2026 (recall number 26-522). It covers Mainstays-brand 9-Drawer Fabric Dressers made by Hop Thang Interior Wood Co. Ltd. of Vietnam and sold only by Walmart.
How to identify the recalled Mainstays dresser
- Black metal frame with nine brown or black fabric drawers with handles.
- About 40 inches long, 13.75 inches wide, and 45 inches tall, weighing 32 pounds.
- Manufactured from September 2023 through December 2025. The Tracking/Lot number and a manufacture date in MM/YYYY format are on a label under the top panel.
- "Mainstays 9-Drawer Fabric Dresser" appears on the packaging and the order receipt.
- Sold at Walmart stores nationwide and on Walmart.com from September 2023 through March 2026 for about $80.
CPSC says the dressers are unstable if not anchored to the wall and violate the mandatory safety standard required by the STURDY Act. The recall notice reported no incidents or injuries.
The August 2026 reannouncement and liquidator sales
On August 27, 2026, Walmart and CPSC reannounced the recall (recall number 26-726) because Walmart distributed recalled dressers after the recall began, and they were sold to consumers through four liquidators: OMG California Community of Riverside, California; Threads of Fenton of Fenton, Michigan; Golden Cone Electronic, Inc. of Elkhart, Indiana; and ReturnPro of Miami, Florida. The total recalled count rose to about 165,250 units. If you bought a Mainstays fabric dresser at a discount or overstock outlet in 2026, check the label.
The earlier Mainstays chest of drawers recall (2017)
This is not the first Mainstays tip-over recall. On September 6, 2017, Ameriwood Home recalled about 1.6 million Mainstays four-drawer chests sold at Walmart and other stores from April 2009 through May 2016 for about $60. They came in alder, black forest, white, weathered oak, walnut, and ruby red, and did not meet the voluntary ASTM F2057-14 stability standard. CPSC had one report of a chest tipping onto a four-year-old. The remedy was a free repair kit with a wall anchor and new feet, available from Ameriwood at 877-222-7460.
Other dressers recalled after sales on Walmart.com
Several third-party sellers on Walmart.com have also recalled dressers under the STURDY Act standard. These are not Mainstays products, and the refund comes from the seller, not Walmart:
| Dresser | Recall date | Units | Seller |
|---|---|---|---|
| EnHomee 9-Drawer Fabric | July 23, 2026 | About 16,809 | Raybee-Direct |
| Segmart 4-Drawer | April 30, 2026 | About 16,440 | SOFT |
| AOWOS dressers | October 16, 2025 | About 700 | AOWOS |
| Gunaito 10-Drawer | October 2, 2025 | About 610 | Gunaito |
For these, the seller asks you to email a photo showing the dresser was disposed of to get the refund. No injuries were reported in any of the four. If you bought a cheap fabric or particleboard dresser online, search the brand name on CPSC's recall list before you assume it is safe.
Is there a Walmart dresser recall lawsuit?
Not that we can find. As of September 2026, we found no class action or individual lawsuit on public dockets or in news reports tied to the 2026 Mainstays fabric dresser recall. That is typical for a recall with no reported injuries and a full refund: there is little left for a class action to recover.
That could change. Two facts in the reannouncement stand out. Federal law makes it unlawful to sell or distribute a consumer product that is subject to a publicly announced voluntary recall (15 U.S.C. section 2068(a)(2)(B)). CPSC's own notice says Walmart distributed recalled dressers post-recall and they reached buyers through liquidators. That violation is enforced by CPSC, which can seek civil penalties; it does not by itself give consumers a right to sue. But it can become evidence in an injury case if someone is hurt by a dresser that should have been pulled from sale.
For the difference between a recall and a lawsuit, and why most recalls never become class actions, see our guide on recalls versus class actions.
Who may qualify for a refund or an injury claim
| Your situation | What you can likely get | Where to go |
|---|---|---|
| Own a recalled dresser, no injury | Full refund (about $80) | Walmart recall program |
| Bought from a listed liquidator | Refund through Walmart | Walmart recall program |
| Old Mainstays 4-drawer chest | Free anchor and feet kit | Ameriwood |
| Tip-over caused an injury | Medical costs, pain, lost income | Individual injury claim |
| Tip-over caused a death | Wrongful death damages | Individual claim by family |
You probably do not have a lawsuit if the dresser never tipped and nobody was hurt; the refund already makes you whole on the purchase price. You also do not need to be in a class to bring an injury claim. Tip-over injury cases are brought one family at a time, which is why a class action and an individual lawsuit are very different tools here.
If you bought the dresser secondhand, on a marketplace app, or at a liquidation store, the recall still covers the product: CPSC's notice identifies recalled units by their description and the manufacture date on the label under the top panel, and the August 2026 reannouncement was issued specifically for people who bought through liquidators. Keep whatever proof of purchase you have, and ask Walmart what it needs when you call. If your dresser is already anchored to the wall, it is still a recalled product, and you can still contact Walmart about the refund.
Injury claims are not limited to recalled models. A dresser that was never recalled can still be defective if it tips too easily, and CPSC data counted 199 reported child deaths from clothing storage unit tip-overs between January 1, 2000 and April 30, 2022, and 171 of those children were 3 or younger.
What compensation could look like in a tip-over case
For owners without injuries, the recall refund is the payout. Walmart asks you to return the fabric drawers to any Walmart store and dispose of the frame under local rules, and it refunds the purchase price.
Injury and death cases are different. They seek medical expenses, future care, pain and suffering, and, for a death, the losses a family suffers. The best known dresser verdicts and settlements involve IKEA's MALM line:
- In December 2016, IKEA agreed to pay $50 million to the families of three 2-year-old boys killed by MALM dresser tip-overs in Pennsylvania, Washington, and Minnesota.
- In January 2020, IKEA agreed to pay $46 million to the parents of 2-year-old Jozef Dudek, who died in California in 2017 when a MALM dresser fell on him. The family's lawyers called it the largest child wrongful death recovery in U.S. history.
Those amounts reflect deaths and years of litigation. They are not typical, and every case turns on its own facts: how the dresser failed, whether it was anchored, the injuries, and the state's law. Nothing here predicts what any case is worth. If money from a claim may affect benefits for a disabled child, read how settlements affect SSI and Medicaid.
The law behind dresser tip-over claims
The STURDY Act and the federal stability standard
Congress passed the STURDY Act (Stop Tip-overs of Unstable, Risky Dressers on Youth) in December 2022. It required CPSC to adopt a mandatory stability rule for clothing storage units. CPSC adopted the ASTM F2057-23 standard as 16 C.F.R. part 1261, effective September 1, 2023, for dressers and chests made on or after that date. The standard tests stability with drawers open and filled, on carpet, and with the force of a child pulling on a drawer. The recalled Mainstays dressers were made from September 2023 on, so the rule applied to all of them.
Product liability theories
Injury claims are usually brought under state product liability law:
- Strict liability for a design defect: the dresser was unreasonably unstable, whether or not anyone was careless.
- Failure to warn: the warnings or anchoring instructions were inadequate.
- Negligence: the maker or seller failed to use reasonable care, for example by continuing to sell a recalled product.
Violating a mandatory CPSC standard can be strong evidence of a defect. The company will usually argue the dresser was not anchored as instructed, and state rules on comparative fault can reduce recovery.
Deadlines for a Walmart dresser claim
The recall refund has no stated end date, but do not wait: the dresser is a hazard in any home with young children.
For injuries, the clock is the statute of limitations. Most states allow two or three years from the injury for a personal injury claim, and some allow as little as one year. Many states pause the clock for injured minors until they turn 18, but that pause may not cover a parent's own claim for medical bills. A wrongful death claim often has its own, shorter deadline measured from the date of death.
Because the rules vary so much by state, anyone with an injury should get advice well before two years have passed.
What to do now if you own a Mainstays dresser
- Check the label. Look under the top panel for the manufacture date between 09/2023 and 12/2025, and match the size and nine fabric drawers.
- Make it safe today. If it is not anchored, stop using it and move it where children cannot reach it.
- Get the refund. Contact Walmart at 800-925-6278 (7 a.m. to 9 p.m. CT, Monday through Friday) or through walmart.com/help or corporate.walmart.com/recalls.
- If someone was hurt, do not return or throw out the dresser. Keep it, photograph it, get medical care, and save every record. A refund exchange may ask you to discard the frame, so talk to a lawyer before doing that.
- Do not sign a release from a retailer or insurer until you know what you are giving up.
- Report tip-overs to CPSC at SaferProducts.gov so the agency can track the hazard.

Walmart Mainstays dresser recall: common questions.
Is there a lawsuit against Walmart for the Mainstays dresser recall?
As of September 2026, we found no class action or other lawsuit filed over the 2026 Mainstays 9-drawer fabric dresser recall. Owners can get a full refund through Walmart. People injured by a dresser tip-over can bring their own injury claims.
Which Mainstays dressers are recalled?
The recall covers Mainstays 9-Drawer Fabric Dressers with a black metal frame and nine brown or black fabric drawers, about 40 inches long and 45 inches tall, made from September 2023 through December 2025. They were sold at Walmart from September 2023 through March 2026 for about $80.
How do I get a refund for the Walmart Mainstays dresser recall?
Contact Walmart at 800-925-6278 or through walmart.com/help or corporate.walmart.com/recalls. Walmart asks owners to return the dresser's fabric drawers to any Walmart store for a full refund and to dispose of the frame under local rules.
Can I sue if a dresser tipped over on my child?
Possibly. Tip-over injuries are usually pursued as individual product liability claims based on design defect, failure to warn, or negligence, and they do not require a recall. Keep the dresser and medical records and act before your state's deadline, which is often two or three years.
What is the STURDY Act?
The STURDY Act is a 2022 federal law that required a mandatory stability standard for dressers and other clothing storage units. The standard, 16 C.F.R. part 1261, applies to units made on or after September 1, 2023, and CPSC says the recalled Mainstays dressers violate it.
How much did IKEA pay for dresser tip-over deaths?
IKEA agreed to pay $50 million in December 2016 to the families of three toddlers killed by MALM dressers, and $46 million in January 2020 to the parents of Jozef Dudek. Those were death cases and do not predict what another case is worth.
Were Mainstays 4-drawer chests recalled?
Yes. In September 2017, Ameriwood Home recalled about 1.6 million Mainstays four-drawer chests sold from April 2009 through May 2016. The remedy is a free repair kit with a wall anchor and new feet from Ameriwood.
