The Farmers Insurance TCPA settlement is closed to new claims: the deadline was September 14, 2026. It covers people on the National Do Not Call Registry who got two or more marketing calls or texts from seven specific Farmers agents or their agencies between April 19, 2020 and June 15, 2026. Valid claimants get a share of a $1.25 million fund, capped at $160 per person.

The case is Heckathorn v. Farmers Insurance Exchange, et al., No. 26SL-CC03879, in the Circuit Court of St. Louis County, Missouri. Farmers denies the claims. The final approval hearing was scheduled for September 23, 2026, and payments will follow only if the settlement is approved.

What the Farmers Insurance TCPA settlement resolves

Spencer Heckathorn sued Farmers Insurance Exchange, Farmers Insurance Company, Inc., and Fire Insurance Exchange in Missouri state court. The lawsuit claims that insurance agents Nickolas Ward, Nate Esparza, Kyle Ryan Gray, Dustin Huffman, Jason Hall, Brian Shirey, and LeNard Rhone made calls and sent texts marketing Farmers insurance to people whose numbers were on the National Do Not Call Registry, in violation of the Telephone Consumer Protection Act, 47 U.S.C. section 227.

Farmers denies the claims, and no court has decided who would win. The court certified the class for settlement purposes only and granted preliminary approval on June 15, 2026.

This is a narrow case. It does not cover every call or text that mentions Farmers, only marketing contacts from those seven agents or their agencies. For how do-not-call claims work in general, see TCPA explained and our page on spam text lawsuits.

Who was eligible for the Farmers settlement?

The court defined the class as everyone who, from April 19, 2020 to the date of preliminary approval (June 15, 2026):

  • received two or more texts or calls from one of the seven named agents or their agencies during a 12-month period, marketing Farmers products or services;
  • had their number on the Do Not Call Registry for more than 30 days when the calls came in; and
  • had a number registered to an individual, not a business.

Excluded: plaintiff's counsel, Farmers and its officers, directors, and employees and their immediate families, and members of the Missouri judiciary. The notice says class members were identified from a list of phone numbers produced in the litigation, and approximately 12,545 people may have received the agents' calls and texts between April 19, 2020 and June 15, 2026.

Being in the class was not enough to get paid. To receive money, a class member had to certify on the claim form that they did not visit any website to request a Farmers insurance quote before the contacts, and that they were not a Farmers customer at the time or within 18 months before.

How much will Farmers claimants get?

Each valid claimant receives a pro rata share of the settlement fund, up to a maximum of $160 per person, after administration costs, attorneys' fees and costs, and the service award are paid.

ItemAmount
Settlement fundUp to $1,250,000
Requested fees and expensesUp to $396,666.67
Requested service award$11,000
Per-claimant cap$160

A quick check shows why many claimants could get the full $160. After the requested fees and service award, roughly $840,000 would remain before administration costs. At $160 each, that covers about 5,200 claimants, which is well over a third of the roughly 12,545-person class. Claim rates in TCPA cases are usually far lower than that. If claims come in above that level, everyone's check shrinks proportionally. The notice says the exact amount cannot be calculated until all valid claims are counted.

For comparison, the TCPA itself allows up to $500 per violating call or text, and up to $1,500 if willful, but that is for individual lawsuits. Class settlements almost always pay a fraction. See how much you can get from a TCPA lawsuit.

How claims were filed

Class members filed a signed claim form by September 14, 2026 in one of three ways:

  1. Uploading a signed claim form on HeckathornTCPASettlement.com.
  2. Mailing the claim form from the postcard notice to Heckathorn TCPA Settlement, c/o Atticus Administration, PO Box 64053, St Paul, MN 55164.
  3. Emailing a signed form to HeckathornTCPAsettlement@atticusadmin.com.

No phone bills or screenshots were required. The claim rested on the class list plus your signed certifications about quote requests and customer status, so the certification had to be truthful. That filing window is now closed.

If you filed, keep your confirmation and make sure the settlement administrator has your current address. Atticus can be reached toll free at 1-800-261-9045. See what to do if you have not received a settlement check if a payment is later issued and never arrives.

The final approval hearing was scheduled in Division 17 of the St. Louis County Circuit Court, 105 S. Central Avenue, Clayton, Missouri. As of September 2026, we had not seen a final approval ruling posted on the settlement website, so check the Settlement Documents page for the court's order.

What if I missed the deadline or still get calls?

If you are in the class and did not file by September 14, 2026 or opt out by August 27, 2026, you will not be paid, and once the settlement is final you release the do-not-call claims it covers against Farmers. The notice says doing nothing means no payment and giving up rights.

The release only reaches the claims in this case. Calls or texts after June 15, 2026, or from other agents or companies, are not covered by this settlement. If you are on the Do Not Call Registry and keep getting insurance sales calls or texts, save screenshots, call logs, and voicemails, and read about robocall lawsuits. People who received many unwanted contacts may have individual claims worth more than a class payment, and a free case review can connect you with independent attorneys who handle TCPA cases.
