What the Flo app privacy settlement resolves
The case is Frasco, et al. v. Flo Health, Inc., et al., No. 3:21-cv-00757-JD, before Judge James Donato in the U.S. District Court for the Northern District of California. The plaintiffs claim that Flo Health shared users' sensitive health information, including menstrual cycle and pregnancy data entered into the app, with third parties, and that Google, Flurry, and Meta (Facebook) received and used that data without users' consent.
The claims include violations of California privacy law such as the California Invasion of Privacy Act. The court certified a nationwide class and a California subclass, and the case went to trial on July 21, 2025. Before the court ruled on their claims, Flo, Flurry, and Google agreed to settle; they deny all of the plaintiffs' allegations and say they did nothing wrong.
The trial ended on August 1, 2025 with a jury verdict finding Meta liable under the California Invasion of Privacy Act for its role in collecting and using health data entered into the Flo App. Meta is not part of this $59.5 million settlement. The settlement website says people eligible for money from the Meta verdict will be contacted later, and that choices made in this settlement do not affect that. In 2021, Flo separately settled Federal Trade Commission allegations that it shared users' health information with outside data analytics providers after promising to keep it private.
Who qualifies for the Flo Health settlement?
| Group | Who |
|---|---|
| Nationwide class | Used Flo in the U.S. and entered period or pregnancy data, Nov. 1, 2016 to Feb. 28, 2019 |
| California subclass | Same, while living in California |
You must have entered menstruation or pregnancy information into the Flo App during the class period. Using Flo only after February 28, 2019 does not qualify you for this settlement.
Excluded are the judges and their families; Flo, Google, Flurry, Meta and their affiliates, officers, and employees; lawyers in the case; people whose claims were already decided or released; and anyone who asked to be excluded from the class by July 20, 2025. How much will Flo settlement claimants get?
The $59.5 million fund pays notice and administration, taxes, service awards, and attorneys' fees before claimants are paid. Class counsel asked the court for $19,366,666.67 in attorneys' fees, about 32.5% of the fund, plus expenses. The court decides the fee at the final approval hearing.
| Share of class filing | Estimated average payment |
|---|---|
| 10% | About $31.94 |
| 25% | About $12.69 |
Those are class counsel's estimates in the August 20, 2026 final approval motion, and they note that the per-claimant amount rises if fewer than 10% of class members file. Authorized claimants who show they were California subclass members, for example with a valid California address, receive twice the pro rata share of claimants from other states, because California's privacy statutes provide statutory damages. Direct notice went to more than three million class members, so the claims rate will drive the final amount. Our guide on why payouts vary explains the math.

Objecting, opting out, and missing the deadline
You can no longer opt out; the deadline to exclude yourself from the certified class was July 20, 2025. If you did not opt out, you are bound by the settlements whether or not you file, so filing a claim is the only way to get paid. To object, file a written objection with the court by October 8, 2026; you can ask in the same filing to speak at the October 29, 2026 hearing.
If you miss the October 15, 2026 deadline, you will not receive money from this $59.5 million fund. That does not affect any rights you may have related to the Meta verdict. See opting out or objecting for how these rights work.
