What the State Farm total loss settlement resolves
The case is Deborah Robin v. State Farm Mutual Automobile Insurance Company, Case No. 24-391-SDD-RLB, in the U.S. District Court for the Middle District of Louisiana. The plaintiff alleges that State Farm breached its insurance policies by not paying Louisiana insureds the full amount of purchasing fees when it paid out total loss claims.
When an insurer totals your car, it owes you the vehicle's actual cash value. The argument in these cases is that replacing a car also costs taxes and government fees, so a payment that leaves them out comes up short. The settlement defines purchasing fees as sales tax plus title fees (including transfer handling fees), notary fees, registration and license plate transfer fees, and tag fees.
State Farm says it complied with its policies and the law, has defenses to the claims, and denies all material allegations. The court has not ruled on the merits. Our total loss car payout lawsuit page explains the different theories behind these cases, including valuation adjustments and unpaid fees.
Who qualifies for the State Farm Louisiana settlement?
You are a class member if all of these are true:
- You were a Louisiana policyholder or insured of an applicable State Farm entity.
- You submitted a covered first-party private passenger auto physical damage claim, meaning a claim on your own policy, between May 17, 2022 and May 21, 2026.
- The claim resulted in a total loss payment from State Farm that did not include purchasing fees.
The class period runs about four years, from May 17, 2022 through May 21, 2026. The notice says people received it because State Farm's records indicate they may be in the class. Claims against another driver's State Farm policy (third-party claims), repairs that were not total losses, and total loss payments that already included the fees are outside this settlement. People who opted out by August 18, 2026 are also excluded.
How much does the State Farm Louisiana settlement pay?
State Farm will pay $28.39 to each eligible class member who submits a valid and timely claim. This is a flat amount, not a share of a fixed pool, so the number of people who file does not shrink your payment.
| Item | Amount | Who pays |
|---|---|---|
| Payment to each valid claimant | $28.39 | State Farm |
| Attorneys' fees and costs | Up to $205,000 | State Farm, separately |
| Service award to Deborah Robin | $5,000 | State Farm, separately |
Because fees are paid on top of class payments, they do not reduce what you get. In exchange, class members who stay in give up any claim for purchasing fees on these total loss claims. Our guide to who pays the lawyers in a class action explains why that structure is less common.

The Arkansas State Farm total loss settlement
A different State Farm total loss case, Chadwick v. State Farm Mutual Automobile Insurance Co., Case No. 4:21-cv-1161, in the Eastern District of Arkansas, alleged that State Farm paid Arkansas insureds less than actual cash value by basing total loss payments on Audatex valuation reports that applied a "typical negotiation adjustment" to comparable vehicles. State Farm denies the allegations.
That settlement made $15,583,700 available and pays 68% of each claimant's typical negotiation adjustment amount, with an estimated average recovery of $489. It covered total loss claims on State Farm Mutual policies issued to Arkansas residents from November 29, 2016 through October 18, 2021. Its claim deadline was August 19, 2026, so it is closed to new claims. The administrator is Rust Consulting.
If you missed a deadline or had a bigger loss
If you did not opt out of the Louisiana settlement by August 18, 2026, you will be bound by it if approved and will release your claim for unpaid purchasing fees, whether or not you file. Filing by October 19, 2026 is the only way to get the $28.39. See opting out or objecting for how releases work.
If you think State Farm undervalued the car itself, not just the fees, that is a separate issue.
