What the European Wax Center settlement resolves
The case is Cumor, Dunn v. European Wax Center, Inc., Case No. 26-CA-002430, in the Circuit Court for the 13th Judicial Circuit in Hillsborough County, Florida, before Judge Melissa Polo. Plaintiffs Jason Cumor and Sydney Dunn allege that European Wax Center's website used pixels, cookies, code, and tracking or analytics tools that disclosed visitors' information to third parties without permission.
The complaint claimed violations of the federal Electronic Communications Privacy Act (18 U.S.C. Section 2511), the Florida Security of Communications Act, the California Invasion of Privacy Act (Cal. Penal Code Section 631), and common law invasion of privacy. The federal Wiretap Act allows statutory damages of the greater of $100 a day or $10,000 under 18 U.S.C. Section 2520, and these laws generally carry large statutory damages. California Penal Code Section 637.2 lets a person injured by an unlawful wiretap recover the greater of $5,000 per violation or three times actual damages. Figures like that are why website tracking suits are filed, even though settlements pay far less per person.
European Wax Center denies that it violated any law and says it settled only to avoid the cost, disruption, and uncertainty of continuing the lawsuit. The court has not ruled on whether the tracking was illegal.
Who is in the European Wax Center settlement class?
The settlement class is all U.S. residents who visited www.waxcenter.com, including but not limited to people who booked an appointment on the site, from June 30, 2023 through April 2, 2026. You did not need to buy anything or book a service; a visit to the website during that period of roughly two years and nine months was enough.
Excluded are the judges and their families; European Wax Center, its affiliates, and their officers, directors, agents, attorneys, and employees; anyone who filed a timely request for exclusion; and the legal representatives of excluded people.
The settlement website says you did not need your IP address to file. Because nearly anyone who browsed the site qualifies, the class is potentially very large, which matters for how much each person gets.
How much will European Wax Center claimants get?
The settlement agreement creates a fund of up to $5 million that pays for:
| Item | Amount |
|---|---|
| Notice and administration | As incurred |
| Attorneys' fees, costs, expenses | Up to $1,666,666.67 requested |
| Service awards | Up to $2,500 each (2 plaintiffs) |
| Cash payment per approved claim | Up to $10 |
The maximum payment is $10 per approved claim, and it will be reduced pro rata if the total value of approved claims exceeds the money available for class members. The fund is a cap, not a guaranteed pool; the notice describes a fund of "up to" $5 million. By our arithmetic, if fees and awards were approved in full, roughly $3.3 million minus administration costs would be left for claims, enough for about 330,000 full $10 payments. If more people filed, each payment falls below $10.
The court decides the actual fees, so the final number can change. For context on why privacy payouts tend to be small, see why class action payouts are smaller than expected.
