What the metformin settlement resolves
The case is In re Metformin Marketing and Sales Practices Litigation, No. 2:20-cv-02324-MCA-MAH, in the U.S. District Court for the District of New Jersey before Judge Madeline C. Arleo. The plaintiffs claim that drugmakers marketed their generic metformin as equivalent to the brand drugs Glucophage and Glucophage XR, when it was contaminated with N-nitrosodimethylamine (NDMA) and did not meet FDA standards. They say consumers and health plans paid for pills they would not have bought.
The FDA recommended recalls in 2020 of certain metformin products that may have contained NDMA above the acceptable intake limit. The FDA told patients to keep taking recalled metformin until a doctor or pharmacist provided a replacement, because stopping it suddenly can be dangerous for people with type 2 diabetes. A recall and a class action are separate things; our guide on recalls versus class actions explains the difference.
Teva agreed to a $3 million settlement and Granules and Heritage (doing business as Avet Pharmaceuticals) agreed to a $2.55 million settlement, and all three deny wrongdoing. The settlements also resolve claims against CVS Pharmacy tied to its sales of these companies' metformin. The case continues against Amneal Pharmaceuticals and Walmart. This settlement covers economic loss only; personal injury and wrongful death claims were never part of it. Our metformin contamination lawsuit page covers the broader litigation.
Who was eligible for the metformin settlement?
There are two overlapping classes, one for each settlement. You were in the Teva class if you were a person or entity in the United States or its territories who paid any amount for a metformin drug for personal or household use made, distributed, or sold by Teva from July 20, 2015 through June 2, 2020. The Granules and Heritage class uses the same definition for products from those companies.
Paying any amount counted, including a copay, and health plans that reimbursed some or all of the price were included as third-party payors. The settlements did not include:
- The settling companies and their affiliates.
- Federal government entities and certain state and local government entities.
- Anyone who bought metformin for resale, or directly from the settling companies.
- Fully insured health plans and pharmacy benefit managers.
- The judges and their immediate families, and anyone who opted out.
Many people do not know which company made their generic metformin. Pharmacy records usually list the manufacturer, which is why the claim process asked for documentation.
How much will metformin settlement claimants get?
The official notice says payments are pro rata: your share depends on how much generic metformin you bought, how much you paid for it, and the total number of valid claims. The court approved these deductions from the $5.55 million fund on August 12, 2026:
| Item | Amount |
|---|---|
| Attorneys' fees | $1,833,333.33 |
| Litigation costs and expenses | $350,631.96 |
| Service awards (8 class representatives) | $3,500 each |
| Notice and administration | Up to $500,000 (cap) |
The administrator's August 4, 2026 report gives a sense of scale. As of August 4, 2026, A.B. Data had received 3,662 presumptively valid claims: 3,428 from consumers claiming $1,241,085.13 in payments and 234 from third-party payors claiming $3,529,541.47. Those claimed totals are unaudited and more claims arrived before the deadline. By our arithmetic, after the fees, costs, and awards above, and assuming the full administration cap, roughly $2.8 million would remain, which is less than the roughly $4.8 million in reported claimed payments. That suggests claimants will get back a portion of what they paid, not all of it, though the final split depends on the court-approved plan of allocation.
No money goes back to the settling companies. Leftover funds go to a court-approved nonprofit as a cy pres award.
How the metformin claim process worked
Consumers filed a consumer claim form online at the official settlement website or by mail to In re Metformin Marketing and Sales Practices Litigation, c/o A.B. Data, Ltd., P.O. Box 173012, Milwaukee, WI 53217. Health plans used a separate third-party payor form. The form asked for the total number of generic metformin prescriptions bought from July 20, 2015 through June 2, 2020 and the total out-of-pocket amount paid.
The court-filed consumer claim form told claimants to provide documents or other proof showing they bought generic metformin at least once, such as receipts, checkbook entries, credit card statements, or pharmacy records. The administrator can ask for more documents after a claim is filed. Consumer identities are kept confidential unless the claimant consents.
The claim deadline was extended once, from July 10, 2026 to August 5, 2026, and the official website now says the claim filing deadline has passed. If you filed:
- Keep your pharmacy records and claim confirmation until you are paid.
- Answer any request from the administrator for more documentation promptly.
- Update your address with the administrator at 1-866-302-6835 if you move.

The court entered its order granting final approval and a final judgment on August 12, 2026, and as of September 2026 the official website has not posted a payment date. The notice says payments go out after final approval and after any appeals are resolved, and the administrator is still reviewing claims. Only two people asked to be excluded as of August 4, 2026. For where updates show up first, see how to check a settlement's status.
If you missed the metformin settlement deadline
If you did not file by August 5, 2026, you will not be paid from these settlements unless the administrator or court accepts a late claim, which is not guaranteed. If you did not opt out by July 24, 2026, you released your economic loss claims against Teva, Granules, Heritage, and CVS over this metformin. The release does not cover claims against Amneal or Walmart, which are still being litigated, so a later settlement with them may be possible.
This settlement never covered health harms.
